Just about everyone has seen an all-terrain vehicle:  A small, three- or four-wheeled, engine-powered vehicle steered with handlebars and meant to be ridden off-road over all sorts of rough terrain. Three-wheeled ATVs, or trikes, were the first type to hit the U.S. market in large numbers in the 1970s. Three-wheelers were involved in so many rollovers, however, that the federal government sued manufacturers for violating the Consumer Product Safety Act. Those sorts of safety concerns brought an end to three-wheeled ATV production in 1987. Later, in 2008, the Consumer Product Safety Act banned three-wheeled ATVs. Even so, the millions of extremely dangerous and defective three-wheelers already sold were never recalled, and many remain in use today.

Four-wheeled ATV sales filled the gap after three-wheelers were no longer available.

Unfortunately, ATVs continue to generate alarming injury rates. According to a December 2011 report from the federal Consumer Products Safety Commission, hundreds of ATV riders of all ages die or suffer permanent serious injuries every year. The agency reports that approximately 115,000 emergency room injuries were associated with ATVs in 2010, with a quarter of those involving children under the age of 16. Between 1982 and 2010, over 11,000 people died in ATV-related accidents, with 314 of those deaths being in New York. Once more, a quarter of the people who died were children under age 16, the agency says.

What Can Cause New York ATV Accidents?

Manufacturers have a duty to produce ATVs that are safe for consumers to use. This means that the ATV’s design has to be safe and that individual ATVs must be safe when they are made and distributed for sale.

Too often that doesn’t happen. ATVs can have defects that make them unsafe. These can be “design defects,” which refer to errors in the ATV’s design that make the ATV dangerous. They also can be “manufacturing defects,” which means that something went wrong when the ATV was made or assembled for sale. There also can be “failure to warn” defects, where a manufacturer knows about a hazard regarding its ATV but doesn’t warn consumers about it. Hundreds of thousands of ATVs have been recalled for a wide variety of defects since 2000.

ATV injuries also can happen when another person’s negligence causes an ATV wreck or some other type of ATV accident.
