Birth Injuries During Labor and Delivery

A “birth injury” means any damage to an infant’s body before, during, or immediately after birth. Sadly, about 27 of every 1,000 births in the United States results in a birth injury.

Sometimes, medical complications can result in birth trauma and injury during labor and delivery. It’s true that many “natural” circumstances can threaten the health of a baby during birth. For instance, the umbilical cord can become compressed or twisted, the baby can be too large for an easy birth, or the baby can be sideways or backwards in the womb.

But the ways in which doctors, hospitals, or other healthcare professionals deal with these and similar dangers can result in serious harm to the child. If healthcare providers make mistakes during the delivery process, they need to be held accountable for the horrific damage that can be done.

Babies are especially vulnerable when medical professionals must induce labor, perform a Cesarean section birth, or carry out mechanically assisted birth (such as using forceps).

Common errors that can happen, and for which medical providers can be held liable, are:

  • Failing to properly handle a difficult or prolonged labor (often due to a large baby)
  • Failing to realize that the baby’s umbilical cord is wrapped around the baby’s neck
  • Unreasonably delaying an emergency Cesarean section
  • Failing to avoid traumatic complications during a VBAC (vaginal birth after C-section) delivery
  • Failing to test and treat conditions during pregnancy, or misdiagnosing conditions
  • Failing to recognize pre-delivery signs that the baby is in distress or at risk of harm

When doctors and health care professionals make these and other mistakes, the results can be catastrophic for the newborn child and the baby’s family. Babies who suffer severe oxygen deprivation or head trauma during delicate birth procedures can die or face disabilities for the rest of their lives.  These can include:

  • Cerebral Palsy
  • Brain Damage
  • Prenatal Suffocation
  • Erb’s Palsy
  • Brachial Plexus Palsy
  • Klumpke’s Palsy
  • Torticollis
  • Shoulder Dystocia
  • Broken Bones
  • Spinal Cord Damage
  • Bleeding and Bruising in the Brain

Birth Defects During Pregnancy

Babies too often suffer birth defects due to harm suffered while the baby is developing during pregnancy. The March of Dimes says that over half of all birth defects are due to unknown causes. Even so, thousands of birth defects and fetal deaths result from causes such as a mother’s exposure to toxic substances. These can include, among many others:

  • Congenital Heart Defects (such as hole in a chamber of the heart)
  • Spinal Bifida (in which the baby’s backbone and spinal canal do not close before birth)
  • Intellectual Deficits (such as reduced intellectual ability, short- and long-term memory problems, and reduced attention span)
  • Microcephaly (abnormally small head)

These types of birth defects can result from a mother’s exposure to a variety of harmful substances, such as polychlorinated biphenyls (PCBs) and other toxic chemicals, many pharmaceutical drugs, heavy metals (like lead and mercury), powerful cleaning solutions, and paint. Birth defects also can happen because of the mother’s prenatal infection with rubella (German measles) or her use of drugs and alcohol.

If chemical and product manufacturers fail to label their products to warn of dangers of birth defects, they can be held responsible.
