Dog bites, even serious ones, are far too common in the United States. According to the Centers for Disease Control and Prevention, 4.5 million Americans are bitten by dogs each year.  Approximately 885,000 of those dog bites are serious enough that they require medical attention, and over 350,000 dog bites are serious enough that the victims seek treatment in the emergency room.  That averages to more than 2,400 dog bites that require medical attention of some kind, somewhere in the United States, every single day.

Public health records show that every year people receive dog bites that result in injuries all over the body, from the head, face and neck to the feet. Among other injuries, non-fatal dog bites result in:

  • Lacerations
  • Punctures
  • Broken and dislocated bones
  • Infection
  • Crush injuries, and
  • Amputations

Seriously injured dog bite victims may require surgery, including plastic surgery to repair  mauling injuries and other disfigurement.

Non-fatal dog bites may impose public health costs, as well. For example, depending upon the health and medical history of the dog, a bite victim may require expensive rabies post-exposure treatments, provided by their physician or a state or local government health department.

Many states have strict “dog-bite” liability statutes that apply when someone’s dog bites another person. Unfortunately for dog bite victims,  New York does not. Instead, New York is a “mixed” law state because it provides strict liability for a dog bite victim’s medical bills, but recovery of additional damages depends upon whether the victim can show that the dog owner knew, or should have known, that the dog was dangerous, meaning it had “vicious propensities.” That includes the propensity to do anything that might endanger the safety of others in any particular situation. Some refer to this as a “one-bite” law for damages that a victim suffers, apart from medical costs.
